Privacy Policy

Kansai Paint Co., Ltd. (the “Company”) and its Subsidiaries (meaning a subsidiary defined in the “Regulation on Terminology, Forms, and Preparation Methods of Financial Statements” (Ministry of Finance Order No. 59 of 1963, including subsequent amendments) located in Japan; such Subsidiaries located in Japan and the Company are hereinafter collectively referred to as the “Group”) will comply with Act on the Protection of Personal Information, hereby stipulate their policy on the protection of personal information this “Privacy Policy” as set forth below, and will appropriately process personal information acquired by the Group.

While this Privacy Policy is the fundamental policy which is common across the Group, in cases where any Subsidiary further prescribed a separate privacy policy as needed concerning specific business operations or the like, such privacy policy will apply to such specific business operations or the like in precedence to this Privacy Policy.

1. Personal Information

The “Personal Information” indicates the “personal information” defined in the Act on the Protection of Personal Information (Act No. 57 of 2003), meaning information relating to a living individual which can be used to identify a specific individual from a name, date of birth, or other descriptions contained therein, or those containing an individual identification code.

2. Acquisition of Personal Information

The Group will acquire Personal Information, after having specified the purpose of use thereof, to the extent necessary and through appropriate means.

3. Purpose of Use of Personal Information

The Group will use Personal Information acquired thereby to the extent necessary for the purposes described below, except in cases where the subject person’s prior consent is acquired and unless deemed as exceptions under applicable laws and ordinances. Also, the Group may jointly use Personal Information acquired thereby as set forth in section 5 below.

(1)Personal Information concerning our customers/trading partners

  • ・To perform business related to sale of products or provision of services
  • ・To perform business related to purchase of goods or receiving provision of services
  • ・To give information regarding products or services
  • ・To perform business related to improvement or development of products and services
  • ・To reply to inquiries and address other communications
  • ・To send notification of lectures, events and the like and request cooperation to questionnaires and the like

(2)Personal Information concerning our shareholders

  • ・To exercise rights and fulfill obligations pursuant to the Companies Act, the Articles of Incorporation, or other rules
  • ・To administer matters related to our shareholders including preparation of records pursuant to various laws and ordinances

(3)Personal Information concerning applicants to our employment/recruitment activities

  • ・To provide information to applicants, and perform business related to our employment and/or recruitment activities

(4)Personal Information concerning our employees and their families

  • ・To communicate with them in a work setting
  • ・To perform business related to personnel matters, labor management, employee welfare, and health care administration
  • ・To educate employees
  • ・Labor union activities
  • ・To contact them in case of emergency
4. Joint Use

The Group may use Personal Information acquired thereby, as described below

(1)Items of Personal Information to be jointly used

  • All or a part of Personal Information acquired by the Group, including name, address, telephone number, age, and the history of purchasing merchandise.

(2)The scope of joint users

  • The Company’s group companies (meaning subsidiary companies and affiliated companies defined in the Regulation on Terminology, Forms, and Preparation Methods of Financial Statements (Ministry of Finance Order No. 59 of 1963, including subsequent amendments), Kansai Paint Health Insurance Society, Kansai Paint Corporate Pension Funds, and Kansai Paint Labor Union.

(3)Purpose of use of the joint users

  • Purpose of use set forth in section 3 above.

(4)Designation, name, and name of the representative who is responsible for the administration of Personal Information to be jointly used

5. Limitation of Provision of Personal Information to A Third Party

The Group will not disclose/provide Personal Information to a third party without the subject person’s consent thereto, except in cases where it is allowed under applicable laws and ordinances.

6. Security Control Measures regarding Personal Information

The Group will take security control measures to appropriately administer Personal Information. The overview thereof is as described below:

(1)Systematic security control measures

  • ・Appointment of persons responsible for processing Personal Information, and clarification of the role performed by them.

(2)Human security control measures

  • ・Education of employees and other personnel concerning appropriate processing of Personal Information.

(3)Physical security control measures

  • ・Limitation on carrying Personal Information by employees and other personnel.

(4)Technical security control measures

  • ・Limitation of the right or setting password to access data that records Personal Information.
7. Consignment of the Processing of Personal Information

The Group may consign all or a part of processing Personal Information to a third party within the scope necessary to achieve the purposes of use thereof. In this case, the Group will appropriately supervise the consignee as necessary.

8. Disclosure of Personal Information

In cases where a request for disclosure of Personal Information is made by a subject person, the Group will disclose such information without delay if it is confirmed that it was made by the subject person himself/herself. Provided, however, that the Group may not disclose all or a part of such information if non-disclosure is allowed by laws or ordinances. When the Group determines not to disclose the information, the Group will provide notice thereof without delay.

9. Correction and Deletion of Personal Information

In cases where the Group receives a request for correction or deletion of Personal Information by a subject person stating that Personal Information held by a company comprising the Group is wrong, and the Group determines that it is necessary to respond to the said request, the Group will correct or delete such Personal Information without delay in accordance with the proceedings prescribed by the Group and notify the same to the user.

10. Suspension of Use and Other Measures regarding Personal Information

In cases where the Group is requested by a subject person to suspend the use or delete Personal Information (the “Suspension of Use and Other Measures”) pursuant to laws and ordinances, the Group will conduct the necessary investigations without delay, and, based on the result thereof and pursuant to applicable laws and ordinances, take Suspension of Use and Other Measures regarding the Personal Information, and notify the subject person to that effect. Provided, however, in cases where the Suspension of Use and Other Measures regarding the Personal Information involve a large expense or otherwise it is difficult to implement the Suspension of Use and Other Measures, if other alternative measures necessary to protect the rights and interests of the subject person could be taken in lieu thereof, the Group will take such alternative measures.

11. Procedures to Change this Privacy Policy

The Group may review and change the terms of this Privacy Policy as appropriate. The privacy Policy after the change shall come into effect upon the posting thereof on the Group’s website.

12. Response to Complaints and Consultations

In cases where the Group receives complaints or consultations by a subject person concerning the processing of personal Information, the Group will appropriately and promptly respond thereto. Also, the Group will promptly and appropriately address requests by the subject person for disclosure, correction, addition, deletion of, or the Suspension of Use and Other Measures regarding Personal Information.
